These Terms of Service ("Terms") form a legal agreement between you and Drivly: DMV Practice Test ("Drivly," "we," "us," or "our") governing your use of the Drivly mobile application and related services. By downloading, accessing, or using Drivly, you agree to these Terms and the Drivly Privacy Policy. If you do not agree, do not use the service.
If you use Drivly for a minor, you represent that you are the minor's parent or legal guardian, or that you otherwise have authority to consent to these Terms on the minor's behalf, subject to the eligibility rules below.
The current version is designed for ordinary noncommercial passenger-vehicle learner permit knowledge-test preparation in California, Texas, Florida, and New York, in English, on iPhone. Features, jurisdictions, languages, content quantities, and platform support may change. Drivly does not currently provide commercial-driver, motorcycle, road-test, driver-education certification, licensing application, appointment booking, or legal services.
Drivly is not a government agency, DMV, licensing authority, school, driving instructor, law firm, or testing provider. It is not endorsed by or affiliated with any state agency unless we expressly state otherwise in writing. Government names, handbooks, and links are used to identify public sources and jurisdictions.
Drivly does not provide official exam questions, guarantee that any question will appear on an examination, guarantee a passing result, determine your eligibility for a permit or license, or replace an official handbook, agency instructions, professional driving instruction, or legal advice. You are responsible for confirming current requirements and following the official instructions that apply to you.
We work to map content to official state sources and to review questions, explanations, sources, and images. Traffic laws, manuals, test blueprints, and agency guidance can change, and errors may occur. Content is provided for study and informational purposes. Before acting on a rule, especially where safety or legal compliance is involved, confirm it against the current official source.
Scores, diagnostics, coverage, mastery, recommendations, countdowns, and mock-test results are learning indicators. They are not an official assessment, prediction, certification, or representation that you are ready for or will pass an examination. Repeated use of the same content may not reflect independent mastery.
You must be at least 4 years old to use Drivly. If you are below the age of legal majority where you live, you may use Drivly only with permission and supervision from a parent or legal guardian. A parent or guardian who permits a minor to use Drivly is responsible for the minor's use and compliance with these Terms.
The current version does not require registration or login. It creates a random installation identifier and stores learning progress primarily on the device. You are responsible for safeguarding the device and its passcode. Drivly does not promise account recovery, cross-device synchronization, or restoration of local progress. Uninstalling the App, deleting local progress, resetting the device, or changing devices may permanently remove progress and pending issue reports.
Subject to these Terms, Drivly grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App for your own lawful, noncommercial learning purposes. You may use links to official sources and share your own learning results where the App provides a sharing function, provided you do not misrepresent Drivly content as official government material.
You may report a suspected wrong answer, unclear explanation, outdated rule, wrong state, missing or incorrect image, typo, or other content issue. A report may include content identifiers, State Pack and App versions, the selected reason, and an optional note. Do not submit personal identifiers, licensing records, medical information, payment information, or confidential exam material.
You retain ownership of your original feedback. You grant Drivly a worldwide, non-exclusive, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate feedback for operating, improving, and securing the service, without payment or attribution, to the extent allowed by law. This license does not give us ownership of personal information, which remains subject to the Privacy Policy.
The App, software, user interface, branding, compilation and arrangement of content, original questions and explanations, graphics, and other Drivly materials are owned by Drivly or its licensors and are protected by applicable intellectual-property laws. The limited license in these Terms does not transfer ownership.
Official handbooks, statutes, agency publications, names, seals, trademarks, and third-party materials remain the property of their respective owners or may be public-domain government works where applicable. Links and citations do not imply sponsorship or endorsement. Your use of third-party sites and materials is subject to their applicable terms.
We may add, modify, remove, suspend, or discontinue features, State Packs, questions, sources, update mechanisms, or the service as a whole. We may correct or withdraw content without notice when needed for accuracy, safety, integrity, or legal compliance. We do not promise that every jurisdiction, topic, or device will remain supported indefinitely.
The App may continue using the last complete approved State Pack when an update fails. You are responsible for installing available App and content updates and for checking the current official materials when the App indicates content may be outdated.
Drivly offers auto-renewable subscriptions through Apple's In-App Purchase system: a weekly subscription for US$3.99 and a monthly subscription for US$9.99. Each plan includes a three-day free trial for eligible users, as determined by Apple. At the end of the free trial, the selected subscription automatically renews at the displayed price unless it is cancelled before the trial or current billing period ends. Payment is charged to your Apple Account, and subscriptions continue to renew for the selected period until cancelled. Prices, taxes, and currency may vary by App Store country or region, and the price shown in the App at the time of purchase controls. You can manage or cancel a subscription in your Apple Account subscription settings. Deleting the App does not cancel a subscription. Apple processes billing and refunds under its terms and policies. Where available, Drivly provides a restore-purchase function for active entitlements.
Drivly may link to official agency websites, Apple services, or other third-party resources. We do not control and are not responsible for third-party availability, content, security, privacy, or terms. Opening a third-party resource may leave Drivly. Your relationship with the third party is governed by its own terms and policies.
If you obtain the App through Apple, you acknowledge that these Terms are between you and the provider of Drivly, not Apple. Apple is not responsible for providing or supporting Drivly except as required by applicable App Store terms. Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent required by the applicable App Store terms.
The Drivly Privacy Policy describes how information is handled and is incorporated into these Terms by reference. Our App Store privacy disclosures describe the data practices of the released App and are updated when those practices change.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVLY IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. WE DO NOT WARRANT THAT DRIVLY WILL BE ERROR-FREE, UNINTERRUPTED, CURRENT, COMPLETE, SECURE, OR SUITABLE FOR YOUR PARTICULAR EXAM; THAT CONTENT WILL MATCH ANY OFFICIAL TEST; OR THAT USE WILL RESULT IN A PASSING SCORE, PERMIT, LICENSE, OR OTHER OUTCOME. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You may stop using Drivly at any time. We may suspend or terminate access to online features, updates, or issue-report services if reasonably necessary to address a Terms violation, abuse, security threat, legal requirement, or service discontinuation. Local App functionality may also stop working after termination or when a compatible version is no longer supported. Sections that by their nature should survive termination will survive, including intellectual-property, disclaimers, and feedback terms.
We may update these Terms to reflect service, legal, security, or business changes. We will update the date above and provide additional notice when required. If you do not agree to updated Terms, stop using Drivly. Material changes will not apply retroactively where prohibited by law.
